Decision brings years of litigation involving the Clipper Mill development to a close
BALTIMORE, Aug. 28, 2026 /PRNewswire/ -- ValStone Partners announced today that the Supreme Court of Maryland has affirmed the dismissal of claims against co-founder Larry E. Jennings, Jr. and other defendants in litigation involving the Clipper Mill development.
The Court's July 13, 2026 decision upholds a ruling by the Circuit Court for Baltimore City, affirmed on appeal by the Appellate Court of Maryland. Maryland's highest court concluded that the plaintiffs had not established the "special injury" required to pursue their claims of "malicious-use-of-process." The Court also declined the plaintiffs' request to expand Maryland law to allow the lawsuit to proceed.
In its conclusion, the court wrote, "The circuit court was correct to dismiss the HOA's complaint alleging malicious use of process, and we accordingly affirm the judgment of the Appellate Court of Maryland."

The Supreme Court's decision leaves the dismissal of all claims against Jennings and the other defendants fully intact, concluding the lawsuit at Maryland's highest judicial level.
